Unità Democratica Giudici di Pace Onorari esprime viva preoccupazione per l’operazione di polizia Mos Maiorum che traccia una divisione netta da Mare Nostrum a Frontex in una situazione che partita da numerosi soccorsi nel rispetto dei diritti umani degli ultimi mesi passerà ad una vera e propria operazione di polizia, che vi si potrebbe contrapporre in una indiscriminata “caccia all’untore” di manzoniana memoria ,anche se originata da intenti di lotta alla criminalità internazionale di sfruttamento dell’immigrazione ,per cui chiede che vi sia un rigoroso controllo e che siano rispettati i diritti umani con tutte le dovute cautele e le garanzie costituzionali.

Mos Maiorum : une vaste opération de police à l’échelle européenne
Les États membres de l’Union européenne (UE) vont mener une opération de police conjointe de grande envergure du 13 au 26 octobre 2014. Frontex et Europol, une agence de l’UE chargée de lutter contre la criminalité transfrontalière, sont associés aux États membres.
L’ONG britannique Statewatch a réussi à obtenir un document officiel du Conseil de l’Union européenne datant du 10 juillet 2014 qui explique les objectifs et modalités de cette opération appelée « Mos Maiorum ».
Objectifs de l’opération
La finalité de l’opération est premièrement, d’« affaiblir la capacité des groupes criminels organisés qui facilitent l’immigration illégale dans l’UE et se concentrera sur les passages illégaux de frontières » ; et deuxièmement, de collecter de l’information sur les principales routes utilisées par les migrants qui entrent de façon dite « irrégulière » et sur les façons d’opérer des réseaux criminels pour faire passer les personnes dans l’UE.
Cette opération va se traduire par :
Des interpellations des migrants en situation irrégulière pour recueillir des informations en vue d’enquêter sur les réseaux criminels ;
L’identification, la poursuite en justice et le démantèlement des réseaux criminels ;
La recherche et l’analyse des routes utilisées par les migrants et les réseaux (à la fois aux frontières extérieures et au sein de l’espace Schengen) ;
À terme, le renforcement des actions afin de lutte contre l’immigration « illégale » (contrôles aux frontières et activités de surveillance).
Les États membres de l’UE et les États de l’espace Schengen sont incités à participer activement à l’opération. Celle-ci sera coordonnée par l’Italie, qui occupe actuellement la présidence du Conseil de l’UE, en lien étroit avec Frontex.
Préoccupations
Derrière l’objectif de démantèlement de réseaux des passeurs, l’interpellation massive de personnes en situation irrégulière est visée. Les contrôles aux frontières extérieures, mais aussi au sein de l’espace Schengen (notamment ports, gares, aéroports) devraient être renforcés pendant cette période.
Le document se garde de préciser le sort réservé aux personnes interpellées, ni la base légale des contrôlées : profil racial, contrôle au faciès ? Des méthodes illégales au regard du droit européen, notamment du code frontières Schengen.
Cela pose aussi des questions en matière de protection des données : quelle utilisation sera faite des données – dont des données personnelles – récoltées ? Les États membres sont censés recueillir le plus de détails possibles sur les migrants interceptés : âge, sexe, nationalité, lieu et date d’entrée, routes utilisées, etc.
Opacité de l’opération est inquiétante. Très peu d’informations sont disponibles et le contrôle démocratique semble avoir été écarté, nous ne disposons pas d’éléments sur l’information du Parlement européen. Quelle sera l’implication concrète des États membres ? L’Espagne a annoncé sa participation. Qu’en est-il de la France ?
Mos maiorum, selon le site belge d’information sur les centres fermés, Getting the voice out, signifierait « mœurs des anciens » ou « coutumes des ancêtres ». Il désigne dans la Rome antique le mode de vie et le système des valeurs ancestrales. Il est souvent pris comme une référence, et est à opposer au spectacle de la décadence du temps présent ! Les cinq fondements de ce concept sont d’un cynisme total au vu des objectifs d’une opération de police :
Fides : fidélité, respect de la parole donnée, loyauté, foi, confiance ;
Pietas : piété, dévotion, patriotisme, devoir ;
Majestas: sentiment de supériorité naturelle d’appartenance à un peuple élu, majesté ;
Virtus : qualité propre au citoyen romain, courage, activité politique ;
Gravitas : ensemble des règles de conduite du Romain traditionnel, respect de la tradition, sérieux, dignité, autorité.
Au lendemain du triste anniversaire du naufrage de Lampedusa d’octobre 2013, le lancement de cette opération illustre le double discours de l’UE. Les déclarations humanistes sur le sauvetage en mer pèsent bien peu au regard de l’ampleur de cette opération de police menée à l’échelle européenne.

“Immigrazione: controlli frontiere con Mos Maiorum
Prende il via il 13 ottobre Mos Maiorum, l’operazione congiunta per il controllo alle frontiere volta a indebolire il ruolo della criminalità organizzata nella tratta di esseri umani e nell’immigrazione irregolare.
L’operazione Mos Maiorum, approvata a luglio in Consiglio dei Ministri dell’Ue, coinvolgerà le polizie europee nelle attività di controllo delle frontiere dal 13 al 26 ottobre. Mos Maiorum sarà coordinata della Direzione centrale dell’immigrazione e della polizia di frontiera del ministero dell’Interno italiano, in collaborazione con Frontex.
Obiettivo principale dell’operazione congiunta è l’indebolimento dei gruppi della criminalità organizzata che favoriscono l’immigrazione clandestina verso l’Ue. Al fine di individuare e studiare le principali rotte dell’immigrazione clandestina e il modus operandi utilizzato dalle reti criminali per la tratta di essere umani, nel corso delle operazioni la polizia avrà inoltre il compito di raccogliere, a fini di intelligence, dati e informazioni quali: data e luogo del fermo, generalità del migrante fermato, rotta e mezzo di trasporto utilizzato, modalità di accesso.
Non sono mancate le polemiche intorno al lancio dell’operazione. Il gruppo GUE, per esempio, ha inviato nelle scorse ore una lettera al Consiglio dei Ministri dell’Ue “per chiedere se Mos Maiorum sia in armonia con gli articoli della Carta dei Diritti e delle Convenzioni che vietano il respingimento dei migranti su basi collettive”.
“Con la scusa della lotta alla criminalità organizzata e alla tratta di esseri umani”, commenta Barbara Spinelli, l’operazione si propone di “rintracciare il più gran numero possibile di migranti cosiddetti irregolari, il più delle volte richiedenti asilo senza documenti, perché in fuga da zone di guerre”.
Sempre ieri, quattro eurodeputate Pd – Silvia Costa, Cecile Kyenge, Elly Schlein e Patrizia Toia – hanno chiesto al Consiglio di chiarire circa lo svolgimento di Mos Maiorum, con particolare alle modalità previste per l’impiego delle banche dati Schengen e alle tutele assicurate ai diritti fondamentali dei cittadini di Paesi Terzi coinvolti.” ( fonte:euroactiv.it)

Delegations will find below the proposal for the Joint Police Operation “Mos Maiorum”, prepared
on the basis of the guidelines set out in the Guide for Joint Police Operation – JPOs (doc. 16825/10
ENFOPOL 343 JAI 995 COSI 76).
1. INTRODUCTION
The Joint Operation (JO) “MOS MAIORUM”, will be implemented from 13 to 26 October 2014,
in the framework of the Italian Presidency of the Council of the European Union.
This J.O. is a continuation of previous operations held during the last Presidencies of the Council of
the European Union, and was prepared on the basis of the guidelines set out in the Guide for Joint
Police Operation – JPOs (doc. 16825/10 ENFOPOL 343 JAI 995 COSI 76). 11671/14 GK/cr 2
The J.O. “MOS MAIORUM” will be an operation aiming at weakening the capacity of organized
crime groups to facilitate illegal immigration to the EU and will be focusing on illegal border
crossing. Another goal of this operation is to collect information, for intelligence and investigation
purposes, regarding the main routes followed by migrants to enter in the common area and the
modus operandi used by crime networks to smuggle people towards the EU territory, focusing also
on the secondary movements.
2. OBJECTIVES
The JO “MOS MAIORUM” is going to be implemented to:
apprehend irregular migrants and gather relevant information for intelligence and
investigative purposes;
identify, prosecute and disrupt organized crime groups;
give a clear and updated situation picture concerning the operational area, modus operandi,
main trends and possible rapid changes in these aspects;
consolidate joint measures to achieve an impact on illegal immigration (border checks and
border surveillance activities);
carry out (based on the outcomes of the risk analysis), control along the main routes of illegal
immigration on the main routes followed by illegal migrant networks (within the Schengen
Area and at the external borders);
collect and analyze information related also to the so called secondary movement.
3. PARTICIPATING COUNTRIES
All Member States and Schengen Associated Countries (SAC) are going to be invited to participate
in the operation. Depending on the internal organization in each country, various law enforcement
authorities will be involved in the operation, especially border guard authorities.11671/14 GK/cr 3

Member States and Schengen Associated Countries are requested to send the confirmation of their
participation to:
– the General Secretariat of the Council (gavriil.kampouroglou@consilium.europa.eu) and
– the Italian MoI – Central Directorate for Immigration and Border Police

indicating, by 5 September 2014, the contact details (email and phone number) of the national
coordinator, that will be responsible for the JO “Mos Maiorum”.
4. MANAGEMENT AND SUPPORT
The JO “Mos Maiorum” will the coordinated by the Central Directorate for Immigration and Border
Police of the Italian Ministry of Interior, in close cooperation with the European Agency for the
Management of Operational Cooperation at the External Borders of the Member States of the
European Union (FRONTEX)
FRONTEX will contribute to the operation by supporting the Italian Authority in providing risk
analysis, forwarding information related to secondary movements and data gathered at the external
borders.
5. DATA COLLECTION AND REPORTING PROCEDURES
In particular, all participating countries, will be asked to collect the following information:
A) interception details: date and time of detection, location and place of interception,
means of transportation;
B) migrants’ details: migrants’ nationalities, gender and age, point and date of entry
in the EU;
C) migrants’ routes: routes, means of transportation and date before interception followed
to arrive in EU; stated routes after interception and migrants’ final destinations;
D) modus operandi: false/falsified travel documents seized, asylum application, indication
of smuggling of irregular migrants, facilitators’ nationality and country of residence,
money paid for the trip by each migrant;11671/14 GK/cr 4

E) observations: free text for other useful information regarding modus operandi or
facilitation.
Different forms, with the same information fields, will be provided for “external borders – red
form” and “secondary movement – blue form” (data related to illegal migrants detected inside the
territory, on internal flight or trans-border area between Member States, etc.).
Both the reporting templates will be in Excel format and they should be filled for each detected
person. However if, in the same incident, there will be a group of people, that provide the same
information, it will be possible to fill only one form. Instructions will be provided to explain how to
fill the forms and the final report that all participants shall send at the end of the JO.

6. FORECAST COSTS
There is no estimation of the general costs of the operation as each participating country and
FRONTEX should cover any financial costs relating to its involvement in this operation.
7. FOLLOW UP
The report on the final operational results made during the implementation of “Mos Maiorum”
operation will be presented to Working Party on Frontiers, on the 11 December 2014, and to SCIFA
on 12 December 2014.
The operational results will be also sent to all Member States and SACs participants before the
mentioned date (11 December 2014)
